These Terms of Service (the “Terms”) govern your access to and use of the Aema's Aura website, store, products, content, and related services (collectively, the “Services”). The Services are operated by AMA GROW Co., Ltd. (“Aema's Aura,” “we,” “us,” or “our”) and are powered by Shopify. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least the age of majority in your place of residence, or use the Services with the consent and supervision required by applicable law. Information you provide must be accurate, current, and complete. You are responsible for safeguarding your account credentials and for activity conducted through your account.

2. Products and information

We aim to describe and display our products accurately. Colors, packaging, and appearance may vary because of screen settings, production updates, or natural variation. Product descriptions, prices, availability, and specifications may be changed without notice. We may discontinue products or limit quantities, customers, or delivery regions where permitted by law.

Fragrance preferences and skin responses vary. Product information is provided for general purposes and is not medical advice. Review the ingredient and usage information and stop use if irritation occurs.

3. Orders, prices, and payment

Submitting an order is an offer to purchase. An order is accepted only after we confirm acceptance and successfully process payment. We may refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, resale activity, or delivery restrictions. If we cancel after payment, we will issue the applicable refund.

Prices and promotions may change without notice. Unless stated otherwise, displayed prices do not include shipping, duties, taxes, or other charges. You agree to provide accurate billing, payment, and delivery information and confirm that you are authorized to use the selected payment method.

4. Shipping and delivery

Shipping methods, charges, processing times, estimated delivery times, customs responsibilities, and procedures for delayed or missing packages are described in our Shipping Policy. Delivery dates are estimates unless applicable law requires otherwise. Delays caused by carriers, customs, weather, or events outside our reasonable control may occur.

5. Returns and refunds

Returns, exchanges, damaged items, and refunds are handled according to our Refund Policy. Nothing in these Terms limits rights that cannot be excluded under applicable consumer-protection law.

6. Acceptable use

You may use the Services only for lawful, personal, and non-commercial purposes. You must not misuse the Services; violate any law or third-party right; transmit malicious code; interfere with security or operation; collect information without authorization; impersonate another person; submit false or misleading information; or use automated systems to access the Services in a manner prohibited by law or by technical controls we clearly communicate.

We may suspend or terminate access when reasonably necessary to protect the Services, customers, third parties, or our legal rights.

7. Intellectual property

The Services and their text, designs, graphics, photographs, video, audio, trademarks, logos, and other content are owned by or licensed to Aema's Aura and are protected by applicable intellectual-property laws. You may use the Services for personal shopping and information only. No content may be copied, modified, distributed, sold, republished, or commercially exploited without prior written permission, except where applicable law permits.

8. Reviews and feedback

If you submit reviews, photographs, suggestions, or other feedback, you confirm that you have the necessary rights and that the content is accurate, lawful, and does not violate another person's rights. You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and display that content for operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy.

9. Third-party services and links

The Services may include tools, payment services, content, or links provided by third parties. Their terms and privacy practices may apply. We are not responsible for third-party websites or services that we do not control. Review their terms before using them or completing a transaction.

10. Privacy

Our collection and use of personal information are described in our Privacy Policy. Shopify also processes information to provide and improve the platform. Information about Shopify's practices is available in the Shopify Consumer Privacy Policy.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will always be uninterrupted, secure, or error-free. Any warranties or conditions that cannot lawfully be excluded remain in effect.

12. Limitation of liability

To the fullest extent permitted by law, Aema's Aura and its directors, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Services or products. Where liability cannot be excluded, it will be limited only to the extent permitted by applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

13. Indemnity

Where permitted by law, you agree to indemnify Aema's Aura against third-party claims, losses, and reasonable costs resulting from your unlawful use of the Services, your material breach of these Terms, or your violation of another person's rights.

14. Changes, severability, and waiver

We may update these Terms to reflect changes to the Services, our practices, or legal requirements. The updated Terms will be posted here with a revised date, and material changes will be communicated where required by law. If any provision is held unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver of that right.

15. Governing law

These Terms are governed by the laws of Thailand, without limiting any mandatory protections available to consumers under the laws of their place of residence. Disputes will be submitted to courts with jurisdiction under applicable law.
